Donation terms and conditions

These terms and conditions manage the operation and management of the donation section of the funeral-notices website (www.funeral-notices.co.uk, hereafter referred to as "the website"). These pages allow money to be donated via a debit or credit card in memory of a person whose funeral notice is published on the website, to a charity, group or cause selected by the next of kin. 

By donating via the website, you have confirmed by action that you accept these terms and conditions. If you do not agree to the terms, please do not donate via the website. 

Donating 

Your donation will be processed by Donatis Payments Limited (hereafter referred to as "the donation processor") on behalf of Reach plc. All donations are paid into a dedicated bank account managed by the donation processor.  With each eligible donation, the donor will have the opportunity to include UK Government Gift Aid which increases the value of the donation made by 25% where the charity, group or cause are eligible to do so. To include Gift Aid with the donation you must be a UK tax payer - full details of the scheme and its requirements are shown when you make the Gift Aid declaration. 

Each funeral notice allows donations to be made for a period of eight weeks. At the end of this period, all donations received for the notice are aggregated and are disbursed within 5 working days.

Deductions

The costs of providing this service are met by deducting a small percentage of the funds raised (4%) excluding any gift aid.  Card charges are also deducted at cost; these are currently 1.3% plus 20p for European cards, and 2.9% plus 20p for non-European cards.  We do not charge charities any monthly fees to receive money from this service and do not make any deductions from the gift aid.

Donations to registered charities 

The funds are paid directly to the chosen charity and a report is sent to the address registered with the charities commission for that charity. The same report details the Gift Aid declarations made, enabling the charity to reclaim Gift Aid.  The donation processor also requests that the charity acknowledge receipt of the funds to the funeral director or individual who placed the notice. 

Donations to causes that are not registered charities 

Funeral Directors are able to nominate a beneficiary for the funds raised that is not a registered charity.  In this instance, the funds are paid by cheque made payable to the beneficiary and sent to the funeral director with a detailed report.  The donation processor requests that the funeral director acknowledge receipt of the funds to the next of kin.

If you wish to cancel a donation you have made

If you have donated via the website and wish to change your mind and obtain a refund, please contact Reach using the details published on the website within 3 working days (Monday to Friday excluding UK public holidays) from the time you made the donation. Refunds will be processed within a maximum of 3 working days - crediting the donation back to the credit or debit card you used to make the donation. Please beware that some card providers can take up to 10 days to credit the refund to your account. 

Donors' personal data 

When you make a donation, your personal data is processed by the donation processor, you can read more about what data they collect, why they need it and what they do with it on their privacy policy at www.donatispayments.co.uk/terms/privacy/.  By using the website, you consent to the processing of your personal data by the donation processor. 

Our Obligations

Under normal circumstances donations can be made via the website 24 hours a day, 365 days a year however, the donation processor reserves the right to make changes as required and suspend access to the service if  necessary. Any claim made by any donor against Reach plc or the donation processor, for any reason, shall be limited to the value of the donation(s) made by that donor.  The donation processor will submit the specific donation bank account for independent audit by the company's auditors on an annual basis.

Donor and general user obligations

You must use the website only for lawful purposes. You also confirm that you are the owner of any credit or debit card used on the website to donate. 

General

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the website.
